Please do not use contracts concluded in the past as templates for new contracts without first consulting us, as these
- may no longer be up to date or
- may contain terms that are unsuitable for your project and/or involve legal risks.
The contract is always signed by the President. As the project manager, you sign for acknowledgment. Before signing, the contract must be subject to examination by the FTGZ. Therefore, please contact us with your draft contracts as early as possible and before the contract begins.
Contracting party
The contracting party is Anhalt University of Applied Sciences, which acts on behalf of its departments and faculty members.
Which contract template do you need?
We can help you determine whether a specific project constitutes contract research, collaborative research, or a scientific service, and we will provide you with the appropriate contract template for your project. The key characteristics for correctly classifying a project are briefly summarized below:
- In a research collaboration, both or all partners design the content of the research project and provide equivalent contributions. They share the financial, technical, scientific, and other risks, as well as the research results and access to them.
- Scientific contract research is the provision of a service to private or public third parties for a fee, aimed at generating new scientific findings. A service, on the other hand, involves the provision of a service to private or public third parties for a fee based on established scientific findings (e.g., routine measurements). It should be noted that within the European Union, all universities must provide their economic services (e.g., contract research, services) without subsidies (generally by determining the market price/full-cost accounting and a profit margin) to prevent state-funded institutions from competing with private providers of such services at low prices by cross-subsidizing their offerings from public budgets.
- Special considerations regarding the involvement of students in a project: Works and results created by students and doctoral candidates that are not produced in fulfillment of an employment contract or official duty toward the university are not subject to the university’s control and cannot be appropriated by the university without a separate contractual provision within the framework of the enrollment or examination regulations. The university must enter into a separate agreement with students regarding compliance with confidentiality obligations and the granting of rights to results. We provide you with the appropriate contract template for this purpose.
